Poise is operated by Aaron Lalor-Fitzpatrick, an independent developer based in Paraguay ("Poise", "we", "us"). By downloading or using Poise, you agree to these terms. They're short and written in plain language.
What Poise is, and isn't
Poise is a self-improvement tool that uses motion data from compatible Apple headphones to give you gentle nudges about your posture. Poise is not a medical device. It does not diagnose, treat, prevent, or cure any condition, and nothing in the app is medical, therapeutic, or professional advice. Poise is not a substitute for care from a qualified healthcare professional. If you have any posture-related concern, existing injury, or condition affecting your neck, back, spine, balance, or inner ear, talk to a professional before using Poise and don't rely on the app in place of their guidance.
Your safety comes first: please read this
Poise works by playing an audio nudge that prompts you to adjust your head and posture. You are always in control of your own body and your surroundings. A nudge is a suggestion, not an instruction to move immediately or without looking.
- Stay aware of your environment. Do not change your posture, lift your head, or shift your gaze in response to a nudge without first making sure it is safe to do so. Watch where you are walking, look out for steps, curbs, obstacles, traffic, drop-offs, and other people.
- Don't use Poise when a nudge could distract you at a dangerous moment. That includes while driving, cycling, crossing roads, walking on stairs or uneven ground, operating machinery or tools, carrying a child or anything hot, heavy, or sharp, or doing anything else that needs your full attention.
- Move gently and within your own comfort. Never force your head or body into a position that hurts. Don't hold a posture longer than is comfortable. If a nudge ever encourages a movement that causes pain, dizziness, or discomfort, stop using Poise and, if needed, seek medical advice.
- Poise is not always right. Motion detection can be imperfect and nudges may fire at unexpected times or not at all. Use your own judgment. Do not treat a nudge, or the absence of one, as a reliable signal of anything.
You use Poise at your own risk. By using the app you acknowledge and accept the risks described above, including the risk of trips, falls, collisions, strain, or other injury that could result from moving, adjusting your posture, or being momentarily distracted while using Poise. To the maximum extent allowed by law, you assume responsibility for how, when, and where you choose to use the app.
Compatible hardware
Poise requires Apple headphones with motion sensors. Currently that means AirPods Pro, AirPods Pro 2, AirPods 3, AirPods 4, AirPods Max, and Beats Fit Pro. We don't guarantee compatibility with future hardware, but we'll do our best to keep up.
Subscriptions
- Poise offers auto-renewing subscriptions billed through Apple.
- Your subscription renews automatically at the end of each billing period unless you cancel.
- You can cancel anytime in your Apple subscription settings; cancellation takes effect at the end of the current period.
- We don't process refunds directly. Please contact Apple Support for refund requests.
Who can use Poise
You need to be at least 13 years old to use Poise. If you are under the age of legal adulthood where you live (18 in most places), you may only use Poise with the involvement and consent of a parent or guardian who agrees to these terms on your behalf. By using Poise, you confirm that you meet these requirements and are able to enter into this agreement.
Acceptable use
Use Poise for yourself. Don't try to reverse-engineer, resell, or rebrand the app. Don't use it in a way that violates any law.
The app is provided "as is"
We work hard to make Poise reliable, but we provide it without warranty of any kind. We don't guarantee that the app will be free of bugs, that motion detection will be perfect, or that nudges will always fire when expected.
Limitation of liability
To the maximum extent allowed by law, Poise and its operators, owners, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. This includes, without limitation, any personal injury, trip, fall, collision, strain, or other bodily harm; any property damage; any health outcome or worsening of a condition; and any lost data, lost profits, or loss of goodwill, whether or not we were advised such damages were possible.
To the maximum extent allowed by law, our total liability to you for any and all claims relating to Poise will not exceed the greater of the amount you paid us for the app in the twelve months before the event giving rise to the claim, or USD $50.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
Indemnification
You agree to indemnify and hold harmless Poise and its operators, owners, and employees from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use or misuse of the app, your violation of these terms, or your violation of any law or the rights of anyone else.
Resolving disputes
If you ever have a problem with Poise, please contact us first. Most issues can be sorted out quickly and informally. If we can't resolve things that way, any dispute will be handled by the competent courts of Paraguay.
To the maximum extent allowed by law, you agree to bring any claim in your individual capacity, and not as a plaintiff or member of any class action, collective, or representative proceeding. Where a jury trial would otherwise be available, you and Poise each waive it.
Governing law
These terms are governed by the laws of Paraguay, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your place of residence give you additional rights that cannot be waived.
Severability
If any part of these terms is found to be unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of the terms will stay in full effect.
Changes
If we update these terms, we'll change the effective date above and highlight material changes inside the app.
